INTRODUCTION
These Terms and Conditions ("Terms") govern the use of transport and carpooling services provided by Lift-U (Pty) Ltd ("Lift-U", "we", "our", or "us"). By using our services, all clients ("you", "your", or "passenger") agree to be bound by these Terms.
SERVICE OVERVIEW
Lift-U provides scheduled transport and carpooling services to and from workplaces. Our goal is to offer safe, reliable, and affordable daily transport for working professionals.
BOOKINGS & SCHEDULING
- Bookings must be made and confirmed at least 7 days in advance.
- Regular clients (monthly subscribers) are allocated fixed pick-up and drop-off times.
- Any change in pickup or drop-off location must be communicated at least 2 days prior to the schedled time and must not intefere with other client's traveling time.
- Lift-U reserves the right to adjust pickup times in case of unforseen traffic or operationsl issues.
FEES & PAYMENTS
- Standard monthly fare: R1 400 per passenger (subject to review annually).
- Payments are due by the 1st of each month in advance.
- Accepted payments methods: EFT or monthly debit orders
- Late payments beyond 7 days may result in suspension of service.
- No refnds are issued for missed rides or cancellations after payment unless Lift-U fails to provide the service.
CANCELLATIONS & REFUNDS
- Client cancellations: must be made in writing at least 24 hors before pickup.
- Refund eligibility: cancellations made after payment but before service start may qualify for a 80% refund.
- Lift-U cancellations: in rare circumstances (vehicle breakdown, emergencies), Lift-U will arrange an alternative vehicle or provide a proportional refund.
PASSENGER CONDUCT
All passengers must:
- Be punctual at agreed pickup points.
- Refrain from smoking, consuming alcohol, or using illegal substances in the vehicle.
- Treat drivers and fellow passengers respectfully.
- Wear seatbelts at al times. Lift-U reserves the right to suspend service to any passenger who breaches conduct rules.
DRIVER RESPONSIBILITIES
- All Lift-U drivers are independent contractors.
- Drivers are responsible for maintaining valid driver's licenses, roadworthy vehicles, and professional conduct.
- Drivers must follow assigned routes and schedules as communicated by Lift-U management.
LIABILITY
- Lift-U takes all reasonable precautions to ensure passenger safety.
- However, Lift-U is not liable for any loss, injury, delay, or damage arising from:
- Traffic accidents beyond our control
- Acts of nature (weather, floods, etc.)
- Theft or loss of personal belongings left in vehicles
- Passengers use the service at their own risk, as permitted by South African law.
INSURANCE
All Lift-U vehicles and drivers are required to maintain valid motor insurance and passenger liability coverage as per South African regulations
PERSONAL INFORMATION
All personal data collected (names, addresses, contact details) is processed in accordance with Lift-U's Privacy Policy and POPIA requirements.
AMENDMENTS
Lift-U reserves the right to amend these Terms at any time. Updated Terms will be posted on our website and take effect immediately upon publication.
GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the Western Cape courts.
